Jane C. Demaray

  43 years' experience:

I was called to the Ontario Bar in 1980. I have acted as litigation counsel in virtually every kind of civil and commercial dispute, and as both an arbitrator and a mediator.

  Commitment to mediation:

My practice has been limited to mediation since 2003. I believe the best result for parties is one they devise for themselves, and helping them to reach that result is the work I choose to do.

  Services provided:

I offer services as a mediator for both in-person and virtual mediations, provided the choice of format is agreed upon by all parties and counsel, and subject to compliance with all COVID guidelines in effect at the date of mediation.

Commitment to parties and the process:

  Preparation:

I read everything that is filed with me, and I do so with care.

  Compassion:

I listen to the parties with patience and kindness.

  Communication:

I work hard to identify the concerns of the parties and to address those concerns in language they can understand.

  Candour:

My feedback, when I give it, is as candid as I can make it. It is not binding on any party, and it is confidential.

  Perseverance:

I am a workhorse. I work tirelessly to advance the mediation process, until either a resolution is reached or the parties tell me to stop.

  Easy arrangements:

  Booking:

My website includes a calendar for reference by parties as they discuss mediation dates. I am generally able to make a date available within 60 days, and often within 30.

  Location for session:

I leave arrangements for premises to the participants. As long as the parties themselves are comfortable with the choice, I am generally happy to go anywhere they choose.

  Fairness re fees:

  Reasonable rates:

My rates are more affordable than those of other senior mediators.

Billings are based on real time:

I do not charge my time in blocks like "whole day".
My bill is based on the actual time spent in mediation.

Preparation & administrative time are capped:

Billing for my time spent in preparation and administration of the case (outside the mediation session) is limited to 2 hours in total.

  No charges for travel:

I do not charge a fee or disbursement for travel to a mediation in Ontario, even if the hearing is out-of-town for me, and even if I pay for accommodation while there.

  Cancellation:

I reserve the right to charge for cancellation, but generally do not do so.
